Terms of Service

Effective date: August 4, 2026

These terms cover your use of Proofling, including written and video testimonial requests, consent, proof cards, proof walls, customer-logo walls, website embeds, billing, and integrations.

1. Parties and Agreement

These Terms of Service are a binding agreement between you and Jake Baden North trading as Donkeh Labs (ABN 87 636 703 254). By accessing or using Proofling, you agree to these Terms.

If you use Proofling on behalf of a company or organization, you confirm that you have authority to accept these Terms for that organization.

2. Service Description

Proofling is a web service for collecting private testimonial requests, sending follow-ups, capturing written or guided video responses and consent, approving proof cards, and publishing proof walls, customer-logo walls, and website embeds.

Proofling may include automation such as Stripe-triggered testimonial asks for future paid customers. Proofling does not promise that any recipient will respond, grant consent, provide a positive testimonial, or buy from you.

3. Accounts and Access

  • You are responsible for keeping your login credentials secure.
  • You are responsible for activity that occurs in your workspace.
  • You must provide accurate account, billing, and organization information.
  • You must notify us promptly if you believe your account has been accessed without permission.

4. Customer Contacts and Testimonials

You are responsible for ensuring that you have a lawful basis to upload customer contact details, send testimonial requests, and use any testimonial content you publish through Proofling.

You must not upload sensitive personal information unless it is necessary and lawful for your use of the Service. You are responsible for reviewing every proof card before publishing it.

If you enable a Stripe-synced customer-logo wall, you are responsible for confirming that the detected company identity is correct. An active subscription alone does not establish trademark permission. Proofling requires the customer to grant the stated customer-logo-public-use permission before the logo can be published or included in portable feeds.

  • Proofling keeps responses private until you approve them for publication.
  • Published proof walls and testimonial share pages are public by design.
  • You must not edit testimonial content in a way that makes it misleading.
  • If a customer withdraws permission or asks to opt out, you must honor that request everywhere, including custom embeds, downloaded data, API/MCP clients, and AI-generated customer displays.

5. Video Testimonials and Consent

A testimonial recipient may choose camera and microphone recording or an available video-file upload. You must not pressure a recipient to record, represent that recording is required when a written option is offered, or upload video or audio you do not have the right to process.

The required video-public-wall-v1 consent permits use on Proofling walls and website embeds only. It excludes paid and social advertising. Advertising use requires the recipient to separately grant the optional video-ads-usage-v1 consent. You are responsible for using each video, audio track, caption, likeness, voice, and attribution only within the consent actually granted and for complying with any additional release or disclosure requirements that apply to you.

If base wall and website-embed consent is withdrawn, Proofling makes the video ineligible for public display and queues its stored upload or asset for deletion. Withdrawing advertising consent alone does not unpublish an otherwise eligible wall or embed video. You must also stop any use outside Proofling that is no longer authorized.

6. Recommendation Intent and Warm Referrals

A recipient may optionally record recommendation intent after submitting feedback. Recommendation intent is separate from testimonial publication consent and any external-review handoff. A recipient may change the answer, and a private improvement note attached to a mixed answer must not be published as testimonial content.

When warm referrals are enabled, Proofling may create a signed referral link, short display attribution code, and activity history whose event payloads omit referred-person contact details. Referral and reward records remain associated internally with the original opportunity. Referral links use the project lifetime shown in the Service, may have no expiry, and may be extended while keeping the same URL. Older explicit referral opt-ins may be backfilled only when they can be matched safely; Proofling does not infer a recommendation answer for a legacy record.

A link click is not proof of a sale or other conversion. Workspace Owners and Admins are responsible for confirming manual conversion status. A connected system may report conversion status through the authenticated developer API using the opaque Proofling referral token and project API credentials; the display attribution code is not an API credential.

A connected Stripe account may confirm a conversion automatically only when your checkout copies the opaque Proofling referral token into Stripe metadata. Proofling may compare an optionally supplied referred identity with a project-scoped fingerprint to reject self-referrals; the raw referred identity is not stored in referral records.

When reward tracking is enabled, Proofling may snapshot the reward promise, qualification rule, reward cap, safeguards, and terms version on a new opportunity; evaluate conversion amount and currency; create eligible pseudonymous reward records; apply the configured hold period; and record approval, fulfillment, reversal, or recovery-required state. Later project edits do not rewrite an earlier snapshotted promise.

Proofling does not select incentives, determine legal eligibility, execute payments or benefits, make automatic clawbacks, or send reward fulfillment webhooks. API and MCP fulfillment actions record an external action that the operator confirms already completed. You are responsible for the reward terms, external fulfillment, disclosures, disputes, tax treatment, consumer-law, employment, and contractual obligations arising from your referral program.

7. Acceptable Use

  • Do not use Proofling for unlawful, deceptive, abusive, or spammy activity.
  • Do not send requests to people who have no reasonable relationship with you or your product.
  • Do not attempt to bypass sending limits, suppression rules, authentication, or authorization checks.
  • Do not reverse engineer, scrape, overload, or interfere with the Service.
  • Do not use Proofling to build or train a competing testimonial automation product.

8. Email Sending and Suppression

Proofling sends testimonial and customer-logo permission request emails based on your selected recipients and campaign settings. Suppressed, bounced, complained, or unsubscribed recipients may be skipped to protect recipients and sender reputation.

You are responsible for the recipient lists and campaign settings you provide. Proofling may pause or limit sending that appears risky, abusive, or non-compliant.

9. Subscriptions and Payment

Paid plans are billed through Stripe. You authorize recurring charges for the plan you select until you cancel. Stripe processes payment details; Proofling does not store full card numbers.

Proofling may offer five one-time customer asks without requiring a payment card. Free asks do not expire or reset. A free ask is used only after a request email is successfully sent.

A paid monthly or yearly plan is required to send more requests, use automated customer triggers or reminders, and publish or embed proof publicly. Replies to previously sent free asks may still be received and reviewed privately.

The Pro plan includes storage for up to 100 ready videos per workspace unless another limit is shown for your plan. Ready videos, active upload reservations, and videos awaiting confirmed provider deletion may count toward capacity. Deleted videos free capacity after Mux confirms cleanup; a retrying or failed deletion may remain visible as pending deletion and continue to count until cleanup completes.

Paid plans include a 14-day money-back guarantee when shown in the pricing or checkout flow. Any founding price or promotional access is offered only on the terms shown in the product or checkout flow and may change for future customers.

10. Integrations

If you connect Stripe or another integration, you authorize Proofling to use the credentials or access you provide to operate the integration for your workspace.

You are responsible for selecting the right products, prices, rules, and delays. V0 Stripe testimonial automation is forward-only and does not backfill historical buyers.

Stripe customer-logo sync is separate from testimonial automation. When enabled, it may reconcile existing and future subscriptions for the selected products, use Stripe customer email to send a dedicated permission request, infer a public business website from permitted metadata or a non-consumer email domain, and fetch public logo assets into private storage. A permission grant does not publish automatically; you must still review and publish each logo. Withdrawal, unpublishing, and subscription ineligibility remove the logo from hosted walls, feeds, API/MCP output, and gated asset delivery.

11. Data and Privacy

Our Privacy Policy explains how we collect, use, store, and disclose information. By using Proofling, you also agree to the Privacy Policy.

12. Intellectual Property

Donkeh Labs owns Proofling, including its software, design, branding, documentation, and product features. You receive a limited, non-exclusive, non-transferable right to use the Service while your account is active and in good standing.

You retain rights in your customer lists, testimonial responses, proof wall content, approved customer-logo selections, and other content you submit. You grant us the rights needed to host, process, display, send, and operate that content through Proofling.

13. Limitation of Liability

Australian Consumer Law notice: statutory rights may apply. Nothing in these Terms excludes rights that cannot be excluded under Australian law.

To the maximum extent permitted by law, Proofling is provided as is and as available. Donkeh Labs is not liable for indirect, incidental, special, consequential, or loss-of-profit damages. Our total liability is limited to the amount you paid for Proofling in the 12 months before the claim.

You remain responsible for your marketing claims, testimonial accuracy, recipient consent, legal compliance, and business outcomes.

14. Indemnification

You agree to indemnify Donkeh Labs against claims, damages, losses, and expenses arising from your use of Proofling, your content, your recipient lists, your published testimonials, or your breach of these Terms.

15. Termination

You may stop using Proofling or cancel your subscription at any time. We may suspend or terminate access for non-payment, security risk, misuse, legal risk, or material breach of these Terms.

16. Changes

We may update these Terms from time to time. Material changes will be posted on this page or notified through the Service. Continued use after changes take effect means you accept the updated Terms.

17. Governing Law and Contact

These Terms are governed by the laws of South Australia. The courts of South Australia have exclusive jurisdiction over disputes.
